Our pledge regarding your health information
Health information about you and your health care is personal. Kindred Wellness (formerly Stone Point Therapy) is committed to protecting that information. A record of care and services is created to provide quality care and comply with legal requirements. This notice applies to all records of your care generated by this mental health care practice.
Our legal obligations include: keeping your protected health information (PHI) private, providing this notice of duties and privacy practices, and following the terms of the current notice.
How your health information may be used and disclosed
For treatment, payment, or health care operations
Your PHI may be used or disclosed without written authorisation for treatment, payment, or health care operations. This includes, for example, consulting with another licensed provider, sending appointment reminders, billing invoices, and other documentation.
Lawsuits and disputes
PHI may be disclosed in response to a court or administrative order, subpoena, or other lawful process, provided efforts are made to notify you first.
Uses and disclosures that require your authorisation
Psychotherapy notes require your authorisation unless used for your treatment, for training mental health practitioners, for legal defence, for HHS compliance investigations, or as required by law.
Marketing: Your PHI will not be used for marketing without prior written consent. A HIPAA authorisation will be requested for any public reviews.
Sale of PHI: Your PHI will not be sold.
Uses and disclosures that do not require your authorisation
PHI may be used or disclosed without authorisation for: appointment reminders, legally required disclosures, public health activities, health oversight, judicial and administrative proceedings, law enforcement, coroners and medical examiners, research, specialised government functions, workers' compensation, and organ/tissue donation.
Your opportunity to object
You have the right to specify whether your PHI may be shared with family members, friends, or others involved in your care or payment.
Your rights
You have the right to:
- Request limits on uses and disclosures of your PHI
- Request restrictions for out-of-pocket expenses paid in full
- Choose how your PHI is sent to you
- See and get copies of your PHI (provided within 30 days of written request)
- Get a list of disclosures made (within 60 days of request, covering the last six years)
- Correct or update your PHI (response within 60 days)
- Get a paper or electronic copy of this notice
- Choose someone to act for you (e.g., medical power of attorney)
- Revoke an authorisation
- Opt out of communications and fundraising
Filing a complaint
If you believe your privacy rights have been violated, you may file a complaint by contacting the HHS Office for Civil Rights at 200 Independence Avenue, S.W., Washington D.C. 20201, by calling (877) 696-6775, or by visiting www.hhs.gov/ocr/privacy/hipaa/complaints.
For EU/EEA clients (GDPR)
If you are based in the European Union or European Economic Area, your personal data is also protected under the General Data Protection Regulation (GDPR). You have the right to access, rectify, or erase your personal data, restrict or object to processing, and data portability. Kindred Wellness processes your personal data on the basis of your explicit consent and for the performance of therapeutic services.
Changes to this notice
The terms of this notice may change, and changes will apply to all information on file. The updated notice will be available upon request and on this website.
